Terms of Service

These Terms of Service govern your access to and use of the Food Mile website, applications, and related services operated by Food Mile LLC. By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.

Food Mile is a discovery platform that helps people find local food producers, growers, markets, and vendors, and review information such as business names, locations, hours, availability, products, pricing, and other informational content.

Unless Food Mile LLC expressly states otherwise in writing, Food Mile is not the grower, producer, seller, packer, distributor, shipper, or guarantor of any food, product, service, listing, or vendor shown through the service.

You may use the service only if you can form a binding contract under applicable law. You must be at least 13 years old to use the service, and at least 18 years old to create or manage a producer, vendor, or business listing account.

If you create an account, you agree to provide accurate, current, and complete information, protect your credentials, promptly update your information when it changes, and accept responsibility for activity under your account.

You may not share credentials, impersonate another person or business, or maintain a misleading or unauthorized listing. We may suspend or terminate accounts that are inaccurate, insecure, unlawful, inactive for extended periods, or otherwise in violation of these Terms.

If you create, claim, manage, or publish a producer, vendor, farm, garden, market, or business listing, you represent and warrant that you have authority to act for that listing and that your listing information is accurate and not misleading.

You are responsible for keeping hours, availability, pricing, location, and product information reasonably current. You must only offer, describe, or promote products and services that you are legally permitted to offer, and you remain responsible for compliance with applicable laws, permits, registrations, labeling requirements, food safety rules, taxes, and insurance obligations.

Any certifications, claims, descriptions, and images that you publish must be truthful and properly supported. You are solely responsible for your listing, your business practices, your products, and your interactions with consumers.

Food Mile does not guarantee that any listing, map location, store status, product description, price, inventory status, availability window, certification, nutritional statement, or producer information is accurate, complete, current, safe, lawful, or fit for any purpose.

Listings may change quickly and may become outdated. A producer shown as open, active, nearby, or available may later be closed, sold out, delayed, relocated, or unavailable. You should independently confirm important details directly with the producer or vendor before making travel, purchase, dietary, or consumption decisions.

Unless Food Mile expressly states otherwise in writing, Food Mile does not own, sell, resell, inspect, warehouse, deliver, fulfill, guarantee, endorse, or take title to products listed through the service.

Any purchase, pickup, reservation, communication, arrangement, or transaction between a user and a producer or vendor is solely between those parties. Food Mile is not responsible for product quality, food safety, allergen exposure, spoilage, contamination, refunds, returns, chargebacks, missed pickups, delivery issues, licensing status, or injuries, losses, or damages arising from any producer, vendor, product, or transaction.

The service may display nutritional information, ingredient information, educational content, generalized health-related information, farming information, or other informational materials. This content is provided for general informational and educational purposes only.

It is not medical advice, diagnosis, treatment, professional dietary advice, or a guarantee of any health outcome. You should consult a qualified physician, dietitian, allergist, or other appropriate professional before relying on health, nutrition, or dietary information, especially if you have allergies, medical conditions, dietary restrictions, or pregnancy-related concerns.

The service may include maps, addresses, coordinates, route links, or location-based search results. These features are provided for convenience only.

Food Mile does not guarantee the accuracy of map placements, coordinates, route guidance, distance estimates, service areas, or navigation results. Real-world conditions may differ from information displayed through the service, and you should confirm locations before traveling.

You may be able to submit or upload content, including account information, listings, descriptions, photos, logos, hours, pricing, notes, comments, messages, reviews, ratings, and other materials. You retain ownership of your content, but by submitting it through the service, you grant Food Mile a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify for formatting, display, distribute, publish, and use that content as needed to operate, improve, market, and provide the service.

You represent and warrant that you own or control the necessary rights, that your content does not violate law or third-party rights, and that it is not false, fraudulent, defamatory, obscene, infringing, or misleading. If the service allows reviews, ratings, testimonials, or feedback, you agree to provide honest, good-faith statements based on actual experiences.

We may remove, restrict, edit, or refuse user content at our discretion. Any feedback, suggestions, ideas, or improvement proposals you provide to Food Mile may be used by us without restriction or compensation to you.

You agree not to:

• violate any law, regulation, or third-party right;
• use the service for fraudulent, deceptive, or misleading purposes;
• scrape, crawl, copy, or harvest data by automated means without authorization;
• interfere with or attempt unauthorized access to the service or related systems;
• upload malware, harmful code, or security exploits;
• impersonate another person, company, or producer;
• misstate certifications, ingredients, origin, availability, or product safety;
• post unlawful, abusive, defamatory, or infringing material; or
• spam, stalk, harass, exploit, or otherwise harm users or businesses.

The service, including its software, interface design, trademarks, logos, graphics, text, compilations, content selection, and overall look and feel, is owned by Food Mile or its licensors and is protected by intellectual property laws.

Except for the limited right to use the service in accordance with these Terms, no rights are granted to you. You may not copy, reproduce, distribute, modify, create derivative works from, reverse engineer, sell, or exploit any part of the service except as permitted by law or expressly authorized in writing.

The service may integrate with or link to third-party tools, websites, maps, payment providers, analytics providers, communication tools, social media platforms, or other services. We do not control and are not responsible for those third-party services, their content, policies, uptime, or practices.

Your use of third-party services may be governed by their separate terms and privacy policies. This includes third-party mapping and sign-in providers that you may choose to use through Food Mile.

Your use of the service is also subject to our Privacy Policy, which explains how we collect, use, and disclose information.

We may modify, suspend, discontinue, or restrict all or any part of the service at any time, with or without notice, and we do not guarantee uninterrupted access, error-free operation, or continuous availability.

We may suspend, limit, or terminate your access if you violate these Terms, your account or content presents legal, security, or reputational risk, your listing appears misleading or unlawful, or we decide to stop offering the service or a feature.

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by law, Food Mile disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.

To the maximum extent permitted by law, Food Mile and its officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or use arising out of or related to the service or these Terms.

To the maximum extent permitted by law, Food Mile's total liability for all claims arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid to Food Mile for the service in the 12 months before the event giving rise to the claim, or one hundred U.S. dollars (US $100).

You agree to defend, indemnify, and hold harmless Food Mile and its officers, directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the service, your user content, your listings, your conduct, your business practices, your violation of these Terms, or your violation of any law or third-party rights.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts serving Lebanon County, Pennsylvania, and you consent to personal jurisdiction and venue there.

These Terms constitute the entire agreement between you and Food Mile regarding the service. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision or any other right. We may update these Terms from time to time, and your continued use of the service after updated Terms become effective means you accept the revised Terms.
